Sub: – Grant of Dearness Allowance to Railway employees – Revised Rates effective from 01.01.2019.

The undersigned is directed to refer to this Ministry’s letter RBE No. 37/2019 dated 06.03.2019 (F.No. PC-VII/2016/I/7/2/1) on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Railway employees shall be enhanced from the existing rate of 12% to 17% of the basic pay with effect from Ist July, 2019.
2. The term ‘basic pay’ in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per ih CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.
3. The Dearness Allowance will continue to be distinct element of remuneration and will not be treated as pay within the ambit of Rule 1303 (FR 9(21)), Indian Railway Establishment Code, Volume – II (Sixth Edition – 1987)- Second Reprint 2005.
4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.
5. This issues with the concunence of Finance Directorate of Ministry of Railways.

The issue regarding grant of financial upgradation under MACPS to Jr. Cashier by not reckoning their appointment/promotion from Sr. Shroff to Jr. Cashier’s post has been under consideration. Since appointment/promotion from Sr. Shroff to Jr. Cashier’s post involve promotion from one cadre to another cadre carrying same Grade Pay without benefit of pay fixation, it has now been decided in consultation with Finance Directorate and Establishment Directorate of Railway Board that while regulating MACP benefits to such staff, the appointment from the post of Sr. Shroff to the post of Jr. Cashier should not be construed as promotion and, therefore, may not be reckoned for the purpose of grant of financial upgradation under MACPS.

2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub:- Fixation of pay of disabled/medically unfit running staff on being appointed against alternative (stationary) posts in revised (7th CPC) pay structure.

As the Zonal Railways are aware, pay of medically unfit Railway servants while absorbing them in alternative post is presently fixed as per instructions contained in Board’s letter No. E(NG)I-2008/RE-
3/4 dated 30.04.2013. These provisions provides that while determining pay in Pay Band for the
purpose of fixation of pay of medically unfit running staff in alternative (stationary) post, an amount
equal to such percentage of basic pay (pay in Pay Band + Grade Pay) representing pay element of
running allowance as may be in force from time to time may be added to the existing pay in Pay Band
and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10,
would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive
post, in suitable alternative post.

2. The above issue of pay fixation of medically disabled/unfit running staff on such circumstances
in pursuance of the ih CPC regime has been under consideration of Board. It is pointed out that upto
and including the 5th CPC pay regime, the pay scales had fixed stages and method of pay fixation of
such running staff was governed in terms of para Nos. 1307 and 1308 of Board’s letter No. E(NG)I-
96/RE-3/9(2) dated 29.04.1999. With the restoration of fixed and defined pay intervals in the form of
distinct cells within each pay level in the ih CPC pay matrix, it is clarified that the principles of pay
fixation enunciated in Board’s letter ibid which will now hold good. This means that while fixing the
pay of a medically decategorised running staff in an alternative stationary post if the resultant pay (after
30% addition) does not correspond to any cell, in the same pay level, then the pay will be fixed in the
next -below cell of the same pay level and difference in pay will be protected as personal pay which will
be adjusted in future increment (s).
3. It may also be noted that pay fixation as per para – 2 above will not apply for medical decategorisation
cases of 6th CPC regime, covered under Board’s letter dated 30.04.2013 referred to at para
01 above.
This issues with the concurrence of Finance Directorate of Ministry of Railways.

Sub: Shortcomings in the UMID Card

The initiative taken by the Railway Board to issue individual UMID Card to the Serving and Retired Railway Employees and their family members is highly appreciable, however, the undernoted issues need to be addressed while issuing UMID Cards to the Railway beneficiaries:-

(a) The column for filling in Blood Group does not provide any option for Sub-groups, such as A1B+, A1- etc., as such, the applicants have to opt for AB+ or AB-, which may cause unwarranted for inconveniences in case of emergency.

(b) However, it is understood that, in Defence Services, Defence Personnel are entitled for “Semi-Private Ward”, who are in erstwhile GP Rs.4200(photocopy enclosed for ready reference), however, in case of Railway beneficiaries, the level of entitlement is “General Ward”, which is quite unjustified and needs to be upgraded to “Semi-Private Ward” at par with their counterpart Defence Services Staff.

It is requested that, the above issue be considered with all seriousness and necessary corrective action taken at the earliest under intimation to this office.

Sub: Item No.05/2014 of PNM/AIRF – Fixation of Pay on Promotion to a post carrying higher duties

and responsibilities but carrying same grade pay

Ref.: Railway Board’s letter No.PC-VI/2014/IR-A/1 dated 09.10.2019

Reference is invited towards AIRF’s PNM Item No.33/2018, vide which a demand was placed to extend benefit of Fixation of Pay in case of Sr. Goods Guard promoted to the post of Passenger Guard(post carrying higher duties and responsibilities, but carrying same Grade Pay).

Railway Board vide their letter under reference dated 09.10.2019 have declined to accept the demand unjustifiably, although Rule 1313 FR(22)(1)(a)(1) of the IREC, Vol. II, which reads as under, provides for it:-

“(a)(1) Where a Railway Servant holding a post, other than a tenure post, in a substantive or temporary or officiating capacity is promoted or appointed in a substantive, temporary or officiating capacity as the case may be, subject to the fulfillment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties and responsibilities of greater importance than those attaching to the post held by him, his initial pay in the time scale of the higher post shall be fixed at the stage next above the notional pay arrived at by increasing his pay in respect of the lower post held by him regularly by an increment at the stage at which such pay has accrued or rupees twenty five only, whichever is more.” Obviously, Sr. Goods Guard, when promoted to Passenger Guard, although in erstwhile same Grade Pay of Rs.4200, has to assume another post, carrying duties and responsibilities of greater importance than those attaching to the post held by him prior to his promotion. As such, fixation of pay under Rule 1313 FR(22)(1)(a)(1) is fully justified.

Since Railway Board have not accepted our demand, as mentioned above, according to their reply, and the employee appointed as Goods Guard gets benefit of fixation of pay under Rule 1313 FR(22)(1)(a)(1) only two times in his whole career up to his/her promotion to the post of Guard(Mail Express), as such, promotion earned by him/her should be counted as “two” instead of three, and they should be extended benefit of third financial upgradation after completion of 10 years service from the last promotion or 30 years of regular service, whichever is earlier, as has been done in the case of Cashier under RBE No.163/2019.

Sub: Timely filling up of vacancies by General Departmental Competitive Examination (GDCE) and Limited · Departmental Competitive Examination (LDCE).

The scheme of General Departmental Competitive Examination ( GDCE) was introduced vide Boards’ letter No. E(NG)1/92/PM 2/16 dated 20.08.1993 to fill up 25% of Direct Recruitment quota vacancies in certain specified group ‘C’ categories to accelerate the process of redeployment of surplus staff. Later on General Managers were delegated powers to fill up upto 50% of the DR quota vacancies as per need, as
well as redeployment of surplus staff.

2. All regular employees working in the lower grades or same grade (except from Safety posts to non-safety posts), irrespective of the cadre in which they are working, possessing the prescribed educational qualifications for direct recruitment are eligible to appear in this examination.

3. This channel as well as the channel of LDCE can be availed by the young, talented and qualified staff working in lower grades for fast track progression to higher grades.

4. Instructions have been issued by the Board from time to time for filling up the vacancies through GDCE and LDCE vide letters of even number dated 02.08.2018, 10.05.2019, 03.07.2019 etc.

5. It is reiterated that Railways should ensure making use of these schemes liberally to fill up the vacancies in time by chalking out suitable action plan for the same.

ईस्ट सेंट्रल रेलवे कर्मचारी यूनियन की आमसभा, आपस में नहीं सरकार से लड़ने की तैयारी करें : शिवगोपाल मिश्रा

मुगलसराय  8 नवंबर। आँल  इंडिया रेलवे  मेन्स फैडरेशन  के महामंत्री शिवगोपाल  मिश्रा ने कहा कि आज भारतीय जो हालात है, उससे इतना तो तय है कि सरकार से  दो दो हाथ करना ही होगा, क्योंकि सरकार निजीकरण और निगमीकरण चाहती है और हम किसी भी कीमत पर निजीकरण और निगमीकरण नहीं होने देंगे, इसलिए आपस में नहीं बल्कि सरकार से लड़ने की तैयारी करें। महामंत्री ईस्ट सेंट्रल रेलवे कर्मचारी यूनियन की आमसभा को संबोधित कर रहे थे।  मुगलसराय रेलवे स्टेशन के सामने हुई ईसीआरकेयू की आमसभा में बड़ी संख्या रेलकर्मचारी शामिल हुए। रेल कर्मचारियों से महामंत्री शिवगोपाल मिश्रा ने कहाकि सरकार ने जो हालात बना रखा है उससे भारतीय रेल तो खतरे में है ही, कर्मचारी भी सुरक्षित नहीं है । सरकार के 100 दिन के कार्ययोजना से समझ ही लेना चाहिए कि सरकार का इरादा क्या है ? सरकार न सिर्फ उत्पादन इकाइयों और कारखानों का निगमीकरण चाहती है, बल्कि वो भारतीय रेल का भी  हर हाल में निजीकरण करना चाहती है। आँल इंडिया रेलवे मैन्स फैडरेशन के इसके सख्त खिलाफ है। महामंत्री ने कहाकि रेलमंत्री और रेलवे बोर्ड को साफ कर दिया गया है कि हम कल भी सरकारी कर्मचारी थे, आज भी है और कल भी सरकारी कर्मचारी ही रहेंगे।

महामंत्री ने कहाकि अब उनकी कार्ययोजना का असर भी  दिखाई देने लगा है। सरकार ने फिलहाल दो तेजस ट्रेन का संचालन शुरु किया है, लेकिन उन्होंने ऐसी ही 150 ट्रेनों  का ऐलान भी किया है। इसके अलावा प्लेटफार्मों को भी वो निजीक्षेत्र में देने की बात कर रहे हैं। सवाल ये है कि इंजन और कोच बनाएं रेलकर्मचारी,  इस ट्रेन पर ड्राईवर रेल का, गार्ड रेल का, मेन्टीनेंस रेल का , पटरी रेल की, जब सब कुछ रेल का है, तो इसका मुनाफा प्राईवेट हांथों में क्यों जाना चाहिए ? सरकार की इस दोषपूर्ण नीति को हम कामयाब नहीं होने देंगे, भले ही इसके लिए हमें कोई भी कीमत चुकानी पड़े।

आज उत्पादन इकाइयों और कारखानों का निगमीकरण करने की साजिश हो रही है। महामंत्री ने कहाकि ऐसा करने की कोई वजह होनी चाहिए। भारतीय रेल की उत्पादन इकाइयों ने काफी कम कीमत पर इंजन तैयार किया, आधे से कम कीमत पर कोच तैयार हो रहे हैं। ये हालात तब है जब मैनपावर कम है। उत्पादन इकाई अपने लक्ष्य के मुकाबले अधिक इंजन और बोगी तैयार कर रही है। रेल कर्मचारियों को जिस काम के लिए ईनाम मिलना चाहिए, उस काम के लिए यहां उन्हें सजा मिल रही है। महामंत्री ने कहाकि  एआईआरएफ ने साफ कर दिया है कि  निजीकरण और निगमीकरण रेल कर्मचारियों को कत्तई स्वीकार नहीं है, अगर ये प्रयास  जारी रहा  तो भारतीय रेल का चक्का जाम करने को मजबूर होंगे।

महामंत्री ने कहाकि ऐसा नहीं है कि सरकार हमारी ताकत को नहीं समझ रही है। हमारी ताकत का ही नतीजा है कि वो यूनियन के मान्यता के लिए होने वाले गुप्त मतदान की हिम्मत नहीं जुटा पा रही है। सरकार को पता है कि चुनाव हुआ तो आँल इंडिया रेलवे मेन्स फैडरेशन फिर मजूबत होकर सामने आएगी, जिस यूनियन को वो चाहते हैं, उसका कोई नाम लेने वाला भी नहीं होगा। डर इस कदर है कि रेलवे बोर्ड चुनाव कराने तक की हिम्मत नहीं जुटा पा रहा है। चूंकि एआईआरएफ रेलकर्मचारियों के बीच में रहा है और सबके साथ मिलकर उनकी मुश्किलों से जूझने वाला  संगठन है, फिर उसे भला कौन पीछे कर सकता है ?
एनई रेलवे मजदूर यूनियन के महामंत्री के एल गुप्ता ने कहाकि आज तक रेल कर्मचारियों ने जो भी सुविधा हासिल की है, वो सब सघर्ष से मिला है।  रेल कर्मचारी संघर्ष में यकीन रखते हैं, हमें पता है कि ताकत के बल पर ही न्याय मिल सकता है।   एआईआरएफ कर्मचारी हितों के साथ कभी समझौता करने वाला नहीं है, सरकार अच्छा काम करेगी, हम उसके साथ रहेंगे, अगर सरकार कर्मचारियों के खिलाफ काम करेगी तो उसका उसी तरह विरोध भी होगा।

ईस्ट सेंट्रल रेलवे कर्मचारी यूनियन के महामंत्री एस  एन पी श्रीवास्तव ने कहाकि पुरानी पेंशन बहाल करने की मांग से फैडरेशन पीछे हटने वाला नहीं है, इस  मसले पर भी हमारा संघर्ष जारी रहेगा। श्री  श्रीवास्तव ने कहाकि कुछ लोग यूनियन को कमजोर करने की साजिश कर रहे है, ऐसे लोगों से हमें  सावधान रहना है, यूनियन एकजुट था और एकजुट रहेगा। उन्होंने कहाकि रेफरेडम  भी आने वाला है, हमें एकजुट होकर अपनी ताकत का अहसाल सभी को कराना होगा। इस जनसभा को  यूनियन के वर्किंग प्रेसीडेंट बालकराम यादव, अपर महामंत्री डी के पांडेय, विश्वमोहन सिंह समेत तमाम अन्य लोगों ने भी संबोधित किया।
आम सभा के पूर्व एआईआरएफ महामंत्री शिवगोपाल मिश्रा के नेतृत्व  में एक प्रतिनिधि मंडल मुगलसराय के मंडल रेल प्रबंधक से मिला। रेल अधिकारियों ने कर्मचारियों के हितों में किए जा रहे कार्यों के बारे में विस्तार से जानकारी दी।

‘IRCTC claims of pvt trains profit is gimmick’, Centre bent upon privatising Indian Railways, says Com. Shiva Gopal Mishra

 All India Railwaymens’ Federation (AIRF) General Secretary Com.  Shiva Gopal Mishra has called the Indian Railway Catering & Tourism Corporation’s (IRCTC) claim of Rs 70 lakh profit for India’s first ‘privately run’ train as a gimmick.

Speaking to media persons here on Friday, he said, except during the Deepavali festival, the Tejas Express has been running 40%-60% vacant. Then how can IRCTC claim profit? The federation is conducting an internal ‘investigation’ into the claims, and
will soon come out with the truth about the ‘profit’, he noted.

He said, the IRCTC is making such claims to encourage privatisation of the India Railways.

“We have seen the fate of Air India and BSNL, which the government wanted to disinvest, and their wrong policies has pushed both these entities into loss making, and the Federation would never allow such a thing to happen to the Indian Railways,” he said.

He charged that the Railway Minister is misleading the people on privatisation of Indian Railways. “Even in Parliament, the Railway Minister has stated that the Union government is not planning to privatise the Railways, but stealthily they are preparing grounds to bring in private players in vital operations,” he said.

‘Helping pvt players’

Com. Mishra said, the government is ‘helping’ private players make profit by providing them the Indian Railways infrastructure.

Your kind attention is invited towards Railway Board’s letter referred to above, through which Selections to be processed on and after 14.12.2018 for promotion of the staff within Group ‘C’ by Selection or Non-Selection process is to be regulated through Objective Type Question Paper with immediate effect, except Accounts and RPF Departments. As you are aware that, there has been system of Subjective Question Paper with certain number of questions of Objective Type for Selections/Non-Selections for promotion, and any Railway employee obtaining 60% marks in Safety Category and lesser prescribed marks in Non-Safety Category Posts with relaxations applicable for Reserved Community candidates is eligible to get placed on the provisional panels of the respective selections. There has been no concept of Negative Marking and  Railwaymen were allowed to attempt full question paper, but after implementation of the instructions contained in Board’s letter supra dated 14.12.2018, large-number of Railway employees appearing in such selections are declared unsuccessful and critical analysis of results of written examinations reveal that their final score was slashed below the prescribed passing marks due to Negative Marking.

 

It is, therefore requested that, Railway Board may review the prescribed benchmark for departmental promotions in view of introduction of 100% Objective Type question papers, so that, Railway employees may get promoted and departmental vacancies may not remain unfilled.

Sub: Employment of Course Completed Railway Act Apprentices in Indian Railways against 20% D.R. Quota

The issue of granting employment in the Railways to Course Completed Act Apprentices, who undergo Apprenticeship Training under the Apprentices Act, is a burning issue which has been deliberated and discussed repeatedly by AIRF at various levels as also at Hon’ble MR’s level.

 

On our consistent persuasions, Railway Board had agreed to allocate 20% Direct Recruitment Quota for  appointment of Course Completed Act Apprentices imparted Apprenticeship Training in different Railway Installations vide Railway Board’s letter referred to above. However, these candidates are required to undergo Written Examination and PET of the same standard with other outsider applicants.

 

In this connection, it would not be out of context to mention here that the Act Apprentices who have completed Apprenticeship Training in different Railway Installations acquire sufficient knowledge of Railway working and the system and gain good experience thereof while undergoing such Apprenticeship Training. They are also subjected to  final exam while granting NCVT Certificate on completion of Apprenticeship Training. It may also be pointed out that, a sufficient number of wards of the Railwaymen undergo this Apprenticeship Training in the Railways with the hope that they would get employment in the Railways on completion thereof.

 

It may be further appreciated that, these Course Completed Act Apprentices are required to pass a number of Written/Practical Examinations during the course of Apprenticeship Training till completion thereof, as such, subjecting them to undergo Written Test and PET with those outsider candidates who apply for appointment in the Railways, against DR Quota, is grossly unjustified.

 

AIRF, therefore, is of the considered view that, with a view to accord justice  to Course Completed Act Apprentices, undergone Apprenticeship Training in different Railway installations, as per Apprentice Act, should no longer be required to pass Written Examination and PET at par with those outsider applicants of the open market who apply for recruitment in the Railways against D.R. Quota, and they should be appointed against 20% D.R. Quota earmarked for them by simply document verification etc., else a separate examination with relax standard be conducted for their recruitment in the Railways.

 

Board are, therefore, requested to issue instructions accordingly at an early date.

Sub: Closer of Railway Printing Presses – Reg.

This refers to AIRF’s letters of even number dated 8th June 2019 and 26th July, 2019(copies enclosed for ready reference). Outsourcing of printing of various important books and forms, used in the Indian Railways with simultaneous closer of Railway Printing Presses, being a burning issue, had been an important matter of discussion for the last more than two years.

 

After detailed deliberations, held in the PNM Meeting of AIRF with the Railway Board, on our regular PNM Agenda Item No.35/2018, Official Side had assured that the undernoted five Railway Printing Presses would not be closed, rather the same would be modernized by providing latest Printing Machinery and Plants:-

 

(i) Byculla(Central Railway), (ii) Howrah(Eastern Railway), (iii)              Rani Bagh/Shakurbasti(Northern Railway),                  (iv) Royapuram/Chennai(Southern Railway), (v) Secunderabad(South Central Railway)

 

In this context AIRF was also advised that the workload of those Printing Presses(other than the above mentioned five) which are to be closed would also be transferred to these five Printing Presses proportionally. It would not be out of context to point out here that, Ministry of Railways had already spent substantial amount with a view to modernizing the aforesaid five Printing Presses as was assured to this Federation. Railway Board’s orders, contained in their letter ibid dated 04.06.2019, issued in total disregard of personal assurance given to AIRF by Hon’ble Minister for Railways, are tantamount to an arbitrary breach of the negotiated settlement. This action of the Railway Board would definitely result in shaking of trust and credibility of the Railway Administration, particularly in the wake of Hon’ble MR’s assurance to continue five Printing Presses which is too has not been honoured.

 

AIRF, therefore, requests your goodself to personally review the entire issue in the light of the foregoing and withdraw Railway Board’s instructions dated supra 04.06.2019 in regard to closing of all the Printing Presses, allowing the captioned five Railway Printing Presses to continue, as already assured to this Federation.

 

An early action in this regard shall be highly appreciated.

Sub: Relieving of Railway employees in time after order for transfer in cases of request transfer.

As the Railway administrations are aware, instructions already exist which provide that in cases of request transfer, the requests should be dealt with in an organized and expeditious manner so that there is no occasion for any grievance in the mind of the staff in regard to the handling of their request.

It has been observed that despite the existence of such instructions, due to administrative exigencies, it sometimes becomes difficult to relieve the transferred employee within a reasonable time, which results in loss of seniority to the employee in his new place of posting. The loss is even greater when he goes to posts one grade below, and new recruits from subsequent batches join before him.

The loss in seniority in such cases .resulting from delayed relieving of the employee often leads to litigation, and strictures passed by Hon’ble Courts. In one such case recently, the Hon’ble CAT/Chennai in OA No.75112019 and other similar OAs, vide their common order dated 05.07.2019, inter-alia observed as under:-
Since it is submitted by the counsel for the applicants that IREC is silent on the above issue and accordingly there is a void in this regard in the policy, we deem it appropriate to direct the first respondent to consider the concern raised in the OAs as a policy issue and take an appropriate decision
on whether and if so, how the interests of such transferred employees should be protected in regard to
their seniority at least from the date from which they were approved for IR T, if they could not be relieved soon thereafter in public interest. Such policy decision may be taken and orders issued within
a period of six months from the date of receipt of a copy of this order. “

The matter has accordingly been considered in the Board. While it may not be desirable/feasible to assign seniority to transferred employee in the new unit from the date of approval of the transfer, when the employee is still actually working in the parent unit, every effort should be made to relieve her/him at an early date. Where delay in relieving of the employee after orders are issued exceeds/is likely to exceed 3 months, the case should be put up by Sr.DPO/WPO to DRM/CWM as the case may be giving specific reasons for the delay and likely date of relief.

Sub: Finalization of APAR for the year 2018-19.
From 2017-18, it is mandated to file APARs for officers at the level of Junior Scale and above through SPARROW application only. A schedule for completion of APARs of Railway Officers was also advised accordingly. This time schedule is sacrosanct and it has to be followed strictly.
2. As per schedule, this is the time for consideration of representation against the APARs, if any. However, it is seen that a number of APARs are still pending with Reporting/Repo’rting/Accepting Authorities. It is also known that the APARs that are not finalized by 31st December, shall be taken as final at whatever stage they are pending.
3. In view of the above, it is requested to bring this to the notice of all officers that the entire process of writing APARs/disposing representations for the year 2018-19 has to be completed by 31st December’19 and no extension of time shall be granted.

 Date of next increment under Rule 10 of Central Civil Services (Revised Pay) Rules, 2016- Clarifications-regarding.

The undersigned is directed to invite the attention to Rule 10 of the CCS (RP) Rules, 2016 which provides for the entitlement of employees for drawal of annual increment either on 1st January or 1st July depending on the date of appointment, promotion or grant of financial gradation. The Sub-Rule (2) thereof provides that increment in respect of an employee appointed or promoted or granted financial up­-gradation including up-gradation under Modified Assured Carrier Progression Scheme (MACPS) during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of an employee appointed or promoted or granted financial up-gradation under MACPS during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.

2. A number of references were received in the Ministry of Finance seeking clarifications regarding drawal of next increment by the employees promoted on 1st July, 2016. On consideration of the matter, Department of Expenditure vide it’s Office Memorandum of even number dated 31.07.2018 has clarified that in case an employee is promoted or granted financial up-gradation including up-gradation under the MACP scheme on 1st January or 1st July, where the pay is fixed in the Level applicable to the post on which promotion is made in accordance with the Rule 13 of the CCS (RP) Rules, 2016, the first increment in the Level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months qualifying service is strictly fulfilled. The next increment thereafter shall, however, accrue only after completion of one year.

3. Consequent upon issue of Office Memorandum dated 31.07.2018 different Ministries/ Departments have sought clarification on applicability of DOE’s O.M dated 31.07.2018 keeping in view the provisions of Rule 10 of CCS (RP) Rules 2016 , Rule 22(I)(a)(1) of Fundamental Rules & provisions of Stepping up of pay. The issues on which various Ministries/Departments have sought clarifications and decisions thereon are brought in the succeeding paragraphs.

Issue No. 1: Whether after promotion on 1st July and fixation of pay with two increments the date of next increment will be 1st January or 1st July

4. During the regime of 6th CPC, when the annual increment was admissible uniformly on 1st July every year, employees completing 6 months and above in the revised pay structure as on 1st July were eligible for grant of increment. In the 7th. CPC regime there are two dates of increments pt January and 1st July. Keeping in view the spirit of 6th CPC, 0.M dated 31.07.2018 was issued providing for accrual of next increment on 1st July/1st January in respect of employees getting promotion on , 1st January/1st July provided 6 months qualifying service is strictly fulfilled.

5. The instructions contained in the O.M. dated 31.07.2018 are self-explanatory in respect of the cases of promotion/financial up-gradation falling on 1st July or 1st January. These instructions provide that in case of promotion/financial up­ gradation on 1st July and 1st January and getting fixation of pay in the Level applicable to the post in which promotion is made in accordance with Rule 13 of the CCS (RP) Rules 2016, the first increment in the level in which promotion is made shall accrue on the following 1st January or 1st July, as the case may be, provided a period of 6 months’ qualifying service is fulfilled.

Issue No.2 : Accrual of next increment in case of regular promotion/financial up­ gradation of an employee on any date other than the date of annual increment and option for pay fixation is exercised under FR 22(I)(a)(1). •

6. The opportunity to exercise of option for pay fixation under FR 22(I)(a)(1) is available to employees in case of promotion/financial up-gradation. Therefore, the Central Government Employee promoted on regular basis/granted financial up­ gradation on any date other than the date of his/her annual increment in lower grade and exercises the option under FR 22(I)(a)(1) read with Department of Personnel & Training’s OM No.13/02/2017-Estt.(Pay-I) dated 27.07.2017 for fixation of pay from the date of accrual of next increment in the scale of pay in lower grade, he may be allowed the 1st increment in promotional grade on 1st January/ 1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1st July/1st January (i.e., the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.07.2018. The next increment, thereafter, shall however, accrue only after completion of one year.

7. Since there is material change, it has also been approved that the employees who have been regularly promoted or granted financial up-gradation on or after 01.01.2016 and desire to exercise/re-exercise option for pay fixation under FR22(I)(a)(l) shall be given an opportunity to exercise or re-exercise of the option there under. Such an option shall be exercised within one month of issue of this O.M.

8. These instructions will be applicable with effect from 01.01.2016.

9. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

95th Annual General Convention of AIRF is being held from 04-06-012-2019 at Chennai. On 04.12.2019, convention was inaugurated by holding Youth Convention.
Day 1 Youth Convention and Safety Seminar:- Young Railway Workers in huge numbers from all affiliates of AIRF participated in Youth Convention and safety seminar held on 04.12.2019. Speaking on the Occasion, Com. Shiva Gopal Mishra/GS/AIRF said that participation of youth workers in Trade Union Activities has become important in the backdrop of bit by bit privatization of Indian Railways and implementation of Anti Labour policies by Govt. and Railway Administration. He said that with the implementation of New Pension System, youth workers is feeling cheated and finding himself/herself insecure socially and economically. NPS is by no means benefiting the workers because of volatile market conditions all over the world. He said in current situation when the country and world is reeling under economic slowdown, if employee covered under NPS retires, he/she would get much lesser amount invested in NPS forget 13%-18% annual return, which is claimed very proudly by PFRDA. Government has failed to ensure the minimum returns on NPS that has put a bigger question mark on whole system. AIRF has spearheaded the sustained struggle since the implementation of NPS. He said that AIRF with sustained struggle had managed to incorporate the provision of Gratuity and Family Pension in NPS, but AIRF will not sit idle till the minimum guaranteed pension is ensured for the staff coming into the purview of NPS.

Bro. Steve Cotton/ITF General Secretary also graced the occasion by extending unflinching support to the workers of the AIRF. Bro. Steve Cotton praised the praised the AIRF for keeping its red flag high in the struggle for the working class.

RESOLUTION IN SUPPORT OF STRIKING FRENCH RAILWAY WORKERS

Three French Railway Unions – CGT, UNSA and FO have started an unlimited strike action from 5th December, 2019 against the plans of the French Government to open up the French Railways for competition, leading to large-scale outsourcing, including Maintenance Sector and Pension Reforms.

All India Railwaymen’s Federation(AIRF) strongly feels that the reforms, which will come into force from 1st January 2020, will lower working conditions of the Rail Workers, cut in wages and restrict Union Rights.

AIRF is unhappy with the plan to change the way pensions are funded, and apprehend;  the move will lower Pension and will not resolve pension issues of part-time workers, particularly women.

AIRF is the largest Federation of the Railway Workers in India, having membership of more than one million, and had conducted three major strikes in the country.

This 95th Annual Convention of AIRF, being held in Chennai from 4-6 December, 2019, along with eight million Railway Workers from 142 unions from 78 countries affiliated to the ITF, extends its support to the Striking French Railway Workers and assure that, millions of Railway Workers from AIRF will stand by the French Railway Workers during their struggle and wish them success.

RESOLUTION TO RATIFY ILO CONVENTION 190

On 21st June 2019, the International Labour Organization(ILO) adopted Convention 190 on “Violence and Harassment in the World of Work”. The Convention addresses a significant problem and will help workers prevent and eliminate Violence and Harassment in the World of Work.

The Convention is a legal instrument agreed by the governments, employers and workers, when ratified(adopted as a part of the national legislation) by a country, becomes legally binding(obligatory) to follow the international standards on Freedom of AssociationRight to Work, Right to Collective Bargaining etc.

Violence and Harassment in the world of work is not acceptable in any form by Managers, Supervisors, Colleagues, Peers as well as third parties, such as clients, customers, friends or relatives of the employers in case of private employers. Governments should adopt laws and regulations against violence and harassment in consultation with the trade unions and employers, who in turn must take appropriate measures to prevent and address violence and harassment at work in order to provide a safe environment.

Violence and harassment, could be sexual harassment, verbal abuse, bullying, mobbing, threats and stalking, single as well as repeated acts. Lack of resources, denied access to services and other deprivations of liberty also constitute forms of violence.

Women are disproportionately affected. According to estimates of the World Health Organization(WHO), 35 percent women worldwide experience physical and or sexual violence in their lifetime. Almost 38 percent femicides are committed by the partners.

 C 190 defines Gender Based Violence(GBV) as “Violence and Harassment directed at persons because of their sex or gender or affecting persons of a particular sex or gender disproportionately, and includes sexual harassment”. Convention’s focus on GBV and its impact in the world of work makes it a very important international instrument.

C 190 covers all workers in Public and Private Sectors, Rural and Urban Areas, Formal and Informal Economy are covered. Everyone in the world of work is covered. No one is left behind!

Everyone has a role to play in this fight. Trade Unions are catalysts for Elimination of Violence and Harassment in the society.

All India Railwaymen’s Federation(AIRF), oldest Federation on the Indian Railways, has been consistently fighting for equality and has been strongly opposing gender-based violence in all forms, be it domestic violence or at work place.

Keeping in view ILO Convention 190All India Railwaymen’s Federation(AIRF), affiliated to International Transport Workers Federation(ITF), expresses its strong support for ratification of the ILO C 190 and thus  this resolution in this 95th Annual Convention of AIRF, being held at Chennai(India) from 04th to 06th December, 2019.

AIRF authorizes ITF to count on our support in all the International Forums, including ILO for ratification of the C 190.

सरकार कर्मचारी यूनियनों को भी समाप्त करने पर तुली है। न यूनियनें रहेंगी और न ही समस्याएं उजागर होंगी। इसके लिए नई नीति बन रही है, जिसमें कर्मचारी संगठन मालिकों के आदेश के बिना हड़ताल की तो बात दूर अपनी बात भी नहीं कह पाएंगे। लेकिन फेडरेशन ऐसा नहीं होना देगा। आंदोलन का बिगुल बज चुका है।

यह बातें आल इंडिया रेलवे मेंस फेडरेशन (एआइआरएफ) के महामंत्री शिव गोपाल मिश्र ने कही। वह सोमवार को रेल अधिकारी क्लब परिसर में एनई रेलवे मजदूर यूनियन (नरमू) के 59वें वार्षिक अधिवेशन के खुले सत्र को बतौर मुख्य अतिथि संबोधित कर रहे थे। महामंत्री ने सरकार पर सीधे हमला बोला। कहा कि यह सही है कि सरकार अंग्रेजी हुकूमत की तर्ज पर कार्य कर रही है लेकिन इसको लेकर तनिक भी भयभीत होने की जरूरत नहीं है। सुनने में आ रहा है कि रेलवे बोर्ड हड़ताल करने वाले कर्मचारियों को बाहर का रास्ता दिखाएगा। यूनियन करने वाले 50 हजार कर्मचारियों को जबरन रिटायर्ड कर दिया जाएगा लेकिन यह सही नहीं है। यूनियन से जुड़े 99 फीसद कर्मचारी अपना 100 फीसद कार्य करते हैं। रेल कर्मचारियों के चलते देश में सस्ते कोच और इंजन तैयार हो रहे हैं। ट्रेनें निर्बाध गति से चल रही हैं। कर्मचारी अपनी कुर्बानियां दे रहे हैं। इसके बाद भी सरकार रेलवे को टुकड़े-टुकड़े में निजी हाथों में सौंपना चाहती है, लेकिन फेडरेशन सरकार की मंशा को पूरा नहीं होने देगा।

एआइआरएफ के महामंत्री ने कहा कि कर्मचारियों के कार्य करने के घंटे बढ़ते जा रहे हैं। संरक्षा कोटियों में भी आठ घंटे से अधिक ड्यूटी ली जा रही है। स्टेशनों और कार्यालयों का नव निर्माण हो रहा है। लेकिन कालोनियों की सुध नहीं ली जा रही। इंटरनेशनल ट्रांसपोर्ट फेडरेशन की चेयरपरसन प्रीती सिंह ने अपने उद्बोधन में आंदोलन में युवाओं और महिलाओं को अपनी भागीदारी सुनिश्चित करने का आह्वान किया। अधिवेशन का संचालन नरमू के अध्यक्ष बसंत लाल चतुर्वेदी ने किया। अध्यक्षता केएल गुप्त ने की। इस मौके पर संयुक्त महामंत्री नवीन कुमार मिश्र, एससीएसटी एसोसिएशन के महामंत्री चंद्रशेखर और मुन्नी लाल आदि मौजूद थे।

नरमू ने निकाला जुलूस, लाल झंडों से रंगा रेलवे परिसर

एनई रेलवे मजदूर यूनियन ने रेलवे स्टेशन से अधिकारी क्लब तक गाजे- बाजे के साथ जुलूस निकाला। कार्यकर्ताओं ने एआइआरएफ और नरमू के पक्ष में जमकर नारेबाजी की। निजीकरण, निगमीकरण व नई पेंशन योजना को लेकर सरकार के विरोध में प्रदर्शन भी किया।

कार्यकर्ताओं ने एआइआरएफ के महामंत्री शिव गोपाल मिश्र और सहायक महामंत्री केएल गुप्त का फूलमालाओं से स्वागत किया। आगे बैंड के साथ घोड़े चल रहे थे, पीछे खुली जीप में पदाधिकारी कार्यकर्ताओं का उत्साह बढ़ा रहे थे। स्टेशन और मुख्यालय परिसर लाल झंडों से रंग गया था।

आल इंडिया रेलवे मेंस फेडरेशन (एआइआरएफ) के महामंत्री शिव गोपाल मिश्र ने कहा कि रेलवे बोर्ड ही नहीं सरकार भी झूठा प्रचार कर रही है कि देश की पहली कॉरपोरेट एक्सप्रेस तेजस 70 लाख के फायदे में है। लोगों को भ्रमित किया जा रहा है। जबकि यह ट्रेन पूरी तरह से घाटे में चल रही है। इसके बाद भी रेलवे बोर्ड ने 150 प्राइवेट ट्रेन और 50 स्टेशनों को निजी हाथों में देने की योजना तैयार कर ली है।

फेडरेशन सरकार की मंशा सफल नहीं होने देगा। ट्रेनों और स्टेशनों को बेचने नहीं देगा। महामंत्री सोमवार को रेलवे अधिकारी क्लब में पत्रकारों से बातचीत कर रहे थे। एनई रेलवे मजदूर यूनियन के 59वें वार्षिक अधिवेशन में बतौर मुख्य अतिथि भाग लेने आए शिव गोपाल मिश्र ने कहा कि न रेलवे का निजीकरण होगा और न ही निगमीकरण। सरकार ने मजबूर किया तो हड़ताल होगा। एक साथ देशभर में भारतीय रेलवे का चक्का जाम हो जाएगा। रेलवे में निजीकरण, निगमीकरण, नई पेंशन योजना, खाली होते रिक्त पद और कर्मचारियों के बढ़ते कार्य की अवधि बड़ी चुनौती बनती जा रही है। चेन्नई में आयोजित एआइआरएफ के अधिवेशन में लड़ाई की रणनीति पर मुहर लग चुकी है। फेडरेशन देश भर के श्रमिक और कर्मचारी संगठनों को एक मंच पर लाने का कार्य करेगा। कर्मचारी संगठन ही नहीं रेल उपभोक्ताओं को भी आंदोलन से जोड़ा जाएगा। क्योंकि अब यह आंदोलन फेडरेशन और रेल कर्मचारियों का ही नहीं आम जन का मुद्दा बन गया है। सेंट्रल ट्रेड यूनियन ने पुरानी पेंशन योजना की बहाली को लेकर बजट सत्र में आठ जनवरी को संसद पर प्रदर्शन करने का निर्णय लिया है।

’ भयभीत होने की जरूरत नहीं, बज चुका है आंदोलन का बिगुल

पेंशन बंद होने से छह लाख से अधिक युवाओं का भविष्य अंधकार में है। फेडरेशन भी संसद सहित देशभर में आंदोलन करेगा। निजीकरण, निगमीकरण पर अंकुश लगाने तथा पुरानी पेंशन योजना की बहाली पर सरकार नहीं मानी तो फेडरेशन बजट सत्र में ही हड़ताल की घोषणा भी कर देगा। लेकिन हड़ताल को राजनीतिक रंग नहीं देगा।

जोधपुर, 19 दिसंबर । आँल इंडिया रेलवे मेन्स फैडरेशन के महामंत्री शिवगोपाल मिश्रा ने कहा है कि सरकार की दोषपूर्ण नीतियों की वजह से कोयला और स्टील की ढुलाई में कमी आई है, इससे भी भारतीय रेल का आँपरेशन रेसियो लगातार बढ़ता जा रहा है। महामंत्री ने रेल को बेचे जाने से बचाने के लिए जंग का ऐलान करते हुए कहाकि इस समय भारतीय रेल के सामने गंभीर चुनौती है, अगर हमने एकजुट होकर संघर्ष नहीं किया तो रेल को बचाना मुश्किल होगा। इतना ही नहीं केंद्र की सरकार पूरी तरह कर्मचारी विरोधी है, वो कानून बनाकर श्रमिकों और श्रमिक संगठनों को पंगु बनाने की साजिश कर रही है।
फैडरेशन के महामंत्री आज जोधपुर में एनडब्ल्यूआरईयू के वार्षिक अधिवेशन को संबोधित कर रहे थे। महामंत्री ने कहाकि सरकार की नीतियों का विरोध करने के लिए अब बड़ा कदम उठाना ही होगा! अगर समय रहते हमने सरकार को सबक नही सिखाया तो जुल्म ज़्यादती बढ़ती जाएगी ! महामंत्री ने कहाकि एआईआरएफ के चेन्नई अधिवेशन में हमने तय किया है अगर अब मंत्रालय निजीकरण, निगमीकरण पर कुछ भी नया कदम उठाता है तो रेल का चक्का जाम किया जाएगा ! इस आंदोलन को कामयाब बनाने के लिए हमें सभी के साथ मिलकर संघर्ष में उतरना होगा, इसके लिए अन्य फेडरेशन, ट्रेड यूनियन, एसोसिएशन से बात की जा रही है और एकराय बनाने की कोशिश हो रही है। यहाँ मौजूद नेताओं और रेल कर्मचारियों ने संकल्प लिया भारतीय रेल भारतीय ही रहेगी, इसे अंबानी अडानी रेल नही होने देंगे ! महामंत्री ने साफ कर दिया कि जब तक एआईआरएफ है हम सरकार के मसूबों को पूरा नहीं होने देंगे, लेकिन आपकी एकजुटता जरूरी है।
महामंत्री ने कहाकि सरकार की गलत नीतियों के कारण आज माल ढुलाई प्रभावित हो रही है, कोयला और स्टील की ढुलाई में लगातार कमी आ रही है। इससे हमारा आँपरेशन रेसियो भी बढ़ता जा रहा है। इसके बाद भी सरकार अपनी दोषपूर्ण नीतियों की समीक्षा कर इसे दुरुस्त करने के बजाए रेलकर्मचारियों को निशाना बनाने की साजिश कर रही है। महामंत्री ने भारतीय रेल के हालातों पर विस्तार से चर्चा की और कहा कि सरकार की नीतियां न सिर्फ रेल और रेलकर्मियों के खिलाफ है, बल्कि ये देश के उन करोड़ों रेलयात्रियों के भी खिलाफ है जो आज भी सफर के लिए रेल का ही सहारा लेते है ! महामंत्री ने कहाकि आज रेलकर्मी 22 हजार ट्रेन रोजाना चला रहे है, फिर भी ऐसा क्या है कि हम 150 कामर्शियल ट्रेन नही चला सकते ? श्री मिश्रा ने निजीकरण और निगमीकरण के खिलाफ निर्णायक संघर्ष का ऐलान करते हुए सरकार पर हमला किया, और कहाकि आज सरकार सिर्फ पांच फीसदी लोगों के बारे में सोचती है, उनके लिए हर सुविधा मुहैया कराई जा रही है, अगर सरकार को बाकी 95 फीसदी लोगों की फिक्र होती तो कम से कम वो रेल बेचने की कोशिश नहीं करती।
महामंत्री ने रेलकर्मचारियों से कहा कि आज सरकार श्रमिको के खिलाफ एक बड़ी साजिश में लगी हुई है, वो श्रमिकों के हितों को कुचलने में लगी हुई है। यही वजह है कि श्रम कानूनों में बदलाव कर ऐसे प्रावधान किए जा रहे जिससे यूनियन कमजोर हो। कहा जा रहा है कि यूनियन बनाने में मालिक की सहमति जरूरी है, अब कौन मालिक चाहेगा कि उसके प्रतिष्ठान में यूनियन बने ? सभी को पता है कि प्राइवेट सेक्टर में जैसे ही यूनियन की बात होती है, अगले ही दिन उस कर्मचारी की छुट्टी कर दी जाती है।
महामंत्री शिवगोपाल मिश्रा ने दोहराया कि एक्ट अपरेंटिस के मामला में हम चाहते कि पुरानी व्यवस्था बहाल हो ! जैसे पहले सभी अपरेंटिस को नोकरी मिलती थी, उसी तरह फिर अपरेंटिसशिप पूरा करने वालो को सेवा में लिया जाए ! उन्होंने कहाकि काफी संघर्ष के बाद फैडरेशन ने लार्सजेस स्कीम को हासिल किया था, कुछ कानूनी अड़चने जरूर आई है, लेकिन भारतीय रेल पर पहला हक उनके बच्चों का है, उन्हें इस स्कीम के तहत नोकरी मिलनी ही चाहिए ! NPS का विरोध पहले की तरह जारी रहेगा, फेडरेशन की मांग है कि पुरानी पेंशन बहाल होनी ही चाहिए ! रिइगेजमेंट से फेडरेशन सहमत नही है, हम चाहते है कि रिटायरमेंट के बाद लोग घर जाएं औऱ नए बच्चों को नोकरी का मौका मिले !
अधिवेशन को एआईआरएफ कोषाध्यक्ष जे आर भोसले ने भी संबोधित किया और कहाकि आज युवाओं को एकजुट होकर सरकार के खिलाफ संघर्ष में आगे आना होगा, क्योंकि उन्हें रेल में अभी लंबे समय तक नौकरी करनी है, अगर अपना और रेल का भविष्य बेहतर बनाना है तो संघर्ष के अलावा कोई विकल्प नहीं है। श्री भोसले ने सरकार पर हमला करते हुए कहाकि भारतीय रेल देश की लाइफ लाइन है, इससे किसी तरह का छेडछाड़ बर्दास्त नहीं किया जा सकता । अधिवेशन को मंडल रेल प्रबंधक के साथ जयपुर के विधायक ने भी संबोधित किया।
एनडब्ल्यूआरईयू के महामंत्री मुकेश माथुर ने एआईआरएफ के इतिहास की चर्चा करते हुए कहाकि फैडरेशन ने कर्मचारियों के हितों के लिए हमेशा से ही संघर्ष किया है और आगे भी करता रहेगा। उन्होने कहाकि भारतीय रेल को बेचने की सरकार की कोशिश को हम सब कामयाब नहीं होने देंगे। श्री माथुर ने महामंत्री से कहाकि एआईआरएफ से आदेश मिलते ही एनडब्ल्यूआर में पूरी तरह रेल का चक्का जाम कर दिया जाएगा। यहां से एक भी ट्रेन आगे नहीं बढ़ पाएगी। अधिवेशन की अध्यक्षता जोनल अध्यक्ष भूपेन्द्र भटनागर ने किया। इस अधिवेशन में चेन्नई में पारित प्रस्तावों पर भी विचार करने के बाद तय किया गया कि इसका पूरी तरह पालन किया जाएगा।

Sub: Brief of the meeting held today with the Chairman and Member Staff, Railway Board

A meeting was held today with the Chairman and Member Staff, Railway Board, wherein the undersigned raised the issue of Career Progression of Railway Employees, particularly working in GP Rs.1800 and  GP Rs.4600. After prolonged discussions, CRB and MS both promised that the issue raised by AIRF, for promotion of the staff, working in GP Rs.1800, to GP Rs.1900, would be considered sympathetically and the issue of LDCE, by reduction of 10% D.R. Quota, would be examined further.

The issue of granting Gazetted Status to Supervisors/SSEs of GP Rs.4600 was also discussed. Since a reference is pending in Ministry of Finance, it was promised by the Member Staff that, he would personally talk to Addl. Secretary(Finance) and would try to get resolved the issue very shortly.

On the issue of recruitment of Course Completed Act Apprentices, the Member Staff has promised that, as per demand of the AIRF, we are formulating some scheme, which will be quite beneficial to Course Completed Act Apprentices.

Position regarding promotion from Level-1(erstwhile Group `D) to Level-2, as on 11.11.2019, as well as Career Advancement, offered through GDCE, as on 11.11.2019, is also enclosed herewith, with the request that, updated position should be sent to AIRF Office for further discussion with the Railway Board. We will also discuss it during our pre-DC/JCM Internal Meeting on 25th this month.

In continuation to our earlier email dated 20th December, 2019, it is also informed you that, the issue of stepping of CLIs was also discussed with the Member Staff Railway Board, and he told us that, he is agreed with the proposal discussed with AIRF and letter to this effect would be issued shortly.

The file of absorption of Quasi-Administrative Railway Staff in the Railways has also been processed to the CRB by the MS.
